Each person Will’s is unique to them.
The nature of your Will and the complexity of the provisions contained therein will be based on your specific requirements and wishes for your estate.
Inheritance Tax advice may also be necessary.
Our fee for a standard, single Will start from £350 plus VAT.
Our fee for standard, joint Wills start from £550 plus VAT.
Any additional work needed to be carried out will be time-recorded and charged at the rate of £250 per hour plus VAT.
Lasting Powers of Attorney (LPA)
There are two different types of Lasting Power of Attorney: A Property and Financial Affairs Power and a Health and Welfare Power.
The Property and Financial Affairs LPA allows whoever you appoint as your attorney(s) to deal with financial matters on your behalf. This would include such matters as dealing with your bank account, claiming benefits, paying bills and even the buying and selling of property,
The Health and Welfare LPA allows your attorney(s) to make decisions about your welfare. This could include decisions about where you live, consent to or refusal of medical treatment and decisions about day-to-day care.
This LPA can only be used should you no longer have the capacity to make your own decisions regarding your health or personal welfare.
You can include restrictions and guidance in the LPAs should you wish.
You may choose to appoint one attorney or more than one. We can discuss how best to appoint multiple attorneys in relation to your own personal circumstances.
The LPA must be registered at the Office of the Public Guardian before it can be used.
Our fee for preparing Lasting Power of Attorney are as follows:
Lasting Power of Attorney for Health & Welfare – £350 plus VAT.
Lasting Power of Attorney for Property & Financial Affairs- £350 plus VAT.
There will also be disbursements payable, namely, the Office of the Public Guardian’s registration fee of £82 per LPA.
Court of Protection
If it is not possible for someone to make a Lasting Power of Attorney as the person no longer has capacity to do so then then a relative or friend can apply for a Deputyship Order from the Court of Protections.
A Deputyship Order gives the applicant the power to act on behalf of the person who has lost their mental capacity.
We can help advise on when it may be necessary to apply for a Deputyship Order and assist you in making an application to the Court of Protection.
Our Fee for applying or a Deputyship Order are £850 plus VAT for a standard application that does not require a Court Hearing.
There are disbursements of £385 for the issuing of the application payable to the Court of Protection.
Should a hearing be required then our fees are charged at the rate of £250 per hour plus VAT.
VAT
Where VAT is charged, it will be at the applicable rate (currently 20%).
